Annual Meeting
The Association's Annual Meeting is on Monday 11 May at the European Parliament, London.

The event will include the AGM and the presentation of the Association’s Awards, which this year are being sponsored by Justis.

Hi Eric
As a new member of staff I am already being asked questions about EU material which I find quite daunting. The latest is that one of our lawyers wants everything I can find on a case before the Court of First Instance and although I have tracked down the judgment, I can’t seem to find the Advocate General's Opinion. Can you help?

Eric says: The case you were asked to investigate was Case T-196/04 Ryanair Ltd v Commission and you already knew that the T prefix meant it was a CFI case (if it had been Case C- then it would have been the Court of Justice). You can find the details on the Curia website, using the search form.

As you say, the judgment is listed but there’s no Opinion.

The simple answer is that, while the ECJ Court of Justice is composed of both Judges and Advocates General, the CFI, which deals with a smaller range of subjects concerning mainly intellectual property and competition policy, does not use Advocates General. That said, it is worth noting that "in exceptional circumstances", the CFI may ask a Judge to carry out that role. Not in this case however, so you may confidently deliver the Judgment you have found.

One last point: remember that CFI judgments can be appealed to the ECJ on points of law, but there is no appeal possible against ECJ rulings.
